The EPA’s Clean Water Act (CWA)
of 1972 requires:
- An
adequate storm water management plan (SWMP)
- Regular
specified storm water inspections
- Implementation
of best management practices (“BMPs”), including:
- Structural controls (such as wattles and silt fences), and,
- Management practices (such as a dedicated concrete washout areas and street sweeping).
The Act authorizes the assessment of civil penalties of up to $27,500
per day for each violation of the Act, plus fines and imprisonment for willful
or negligent violations.
